Terms & Conditions
These Terms & Conditions govern quotations, bookings, transport arrangements and related services provided by AVIO Group.
Scope and contracting party
The services, agreements and contractual relationship covered by these conditions.
These Terms & Conditions govern the use of this website and, together with an accepted quotation, booking confirmation, transport order, service instruction or separate written agreement, form part of the contractual relationship between the customer and AVIO Group.
If a specific written agreement or confirmed service condition conflicts with these general terms, the specific written agreement will take priority. Nothing in these terms excludes or limits any mandatory statutory right that cannot lawfully be excluded.
Quotations and bookings
How transport prices are calculated, accepted and confirmed.
- Quotations are prepared using the information supplied by the customer and remain valid only for the period stated in the quotation.
- A booking becomes binding when it is accepted or confirmed by AVIO Group in writing, or when performance begins with the customer's knowledge and agreement.
- The customer must provide complete and accurate information regarding the goods, dimensions, weight, value, collection and delivery addresses, site access, loading conditions, handling requirements and requested delivery times.
- Quotations may be revised where the actual service differs from the information originally provided.
- Additional charges may apply for waiting time, failed collection or delivery, redelivery, storage, special equipment, access restrictions, customs formalities, tolls, ferries, permits, escorts or other services not included in the original quotation.
Customer responsibilities
Information, preparation and access requirements that must be met before transport begins.
- All goods must be lawful, accurately described, suitably packaged, clearly labelled and adequately secured for the agreed method of transport.
- The customer must disclose before booking whether the goods are dangerous, fragile, high-value, temperature-sensitive, perishable, oversized, heavy, contaminated or otherwise subject to special handling or regulation.
- All required customs declarations, invoices, licences, permits, certificates and supporting documents must be complete, accurate and supplied on time.
- Collection and delivery locations must be safe and reasonably accessible for the agreed vehicle and equipment.
- An authorised person must be available at collection and delivery where loading, unloading, inspection or signature is required.
- The customer is responsible for reasonable loss, delay, damage or additional cost caused by inaccurate information, inadequate packaging, undisclosed characteristics, unsafe access or failure to meet these obligations.
Performance, timing and subcontractors
Operational scheduling, estimated delivery times and the use of qualified transport partners.
Collection and delivery dates or times are estimates unless AVIO Group expressly confirms a guaranteed or time-critical service in writing. Performance may be affected by traffic, weather, border controls, customs procedures, road closures, mechanical failure, industrial action, public restrictions, accidents or other circumstances outside reasonable control.
AVIO Group may appoint qualified carriers, drivers, agents, warehouses or subcontractors to perform all or part of a transport service. Their involvement does not reduce any responsibility retained by AVIO Group under applicable law or the agreed contract.
Charges and payment
Pricing, taxes, invoicing and the customer's payment obligations.
Unless expressly stated otherwise, prices exclude applicable taxes, customs duties, import charges and third-party costs. Invoices must be paid in full by the due date shown on the invoice or agreed in writing.
AVIO Group may require advance payment, a deposit, payment security or cleared funds before reserving transport capacity, beginning collection, releasing documents or completing delivery.
Where permitted by law, overdue amounts may incur statutory interest, reasonable recovery costs and suspension or cancellation of further services. Any invoice query must be raised promptly, and undisputed amounts remain payable when due.
Liability, claims and insurance
Applicable transport liability, claims procedures and cargo insurance responsibilities.
Liability may be governed or limited by mandatory national legislation, applicable international transport conventions, carrier conditions and the specific service agreement. AVIO Group does not exclude or limit liability where doing so is prohibited by law.
Unless cargo insurance is expressly included and confirmed in writing, the customer is responsible for arranging suitable insurance for the full value and nature of the goods.
Visible damage, shortage or irregularity should be recorded on the transport or delivery document before acceptance wherever possible. Claims must be submitted without unreasonable delay and must include all available supporting evidence, such as the transport reference, photographs, invoices, repair estimates, delivery records and proof of value.
Cancellation, prohibited goods and force majeure
Cancellation charges, restricted cargo and events beyond reasonable control.
Cancellation charges may apply once a vehicle, driver, carrier, ferry, warehouse, permit or other transport capacity has been reserved. The amount may reflect costs already incurred, lost capacity and the notice provided before the scheduled service.
AVIO Group may refuse, suspend or terminate a service where goods are prohibited, unsafe, inadequately packaged, inaccurately described, unpaid, outside the agreed scope or where performance would breach applicable law or create an unreasonable risk.
Neither party will be liable for failure or delay caused by an event beyond reasonable control. The affected party should notify the other as soon as reasonably possible and take reasonable steps to limit disruption and additional cost.
Law, jurisdiction and contact
Applicable law, dispute resolution and official contact information.
The governing law and competent courts will be determined by the accepted quotation, booking confirmation, service agreement and any mandatory law or international convention applicable to the transport service.
The parties should first attempt to resolve any dispute through direct and good-faith communication before beginning formal proceedings.
Questions concerning these Terms & Conditions, a booking or a transport agreement may be sent to info@avio-group.com.
30-Day Product Guarantee — Terms
Eligible transported products are covered by a contractual 30-calendar-day product guarantee. The guarantee period begins at the moment the customer receives the product, as evidenced by confirmed delivery or other reliable proof of receipt.
During this period, the customer may notify the Company if the delivered product materially does not correspond to its documented description. A claim should identify the shipment and product, describe the discrepancy and include reasonable supporting evidence such as photographs, video or relevant documents.
If a claim is accepted, the Company will provide the applicable return or collection instructions. The customer should not independently dispatch the product before receiving those instructions. The returned product should include the accessories, documents and components originally supplied, where applicable.
The guarantee does not ordinarily cover problems caused solely after receipt by misuse, negligent handling, unauthorized modification or repair, improper storage or installation, normal wear and tear, or characteristics expressly disclosed and accepted before shipment. This contractual guarantee supplements and does not exclude, restrict or replace mandatory statutory or consumer rights.
GUARANTEE
30-Day Product Guarantee
Every eligible product transported through our service includes a contractual 30-calendar-day product guarantee. The guarantee is attached to the shipment from the beginning of order processing, while the 30-day period itself begins from the moment the customer receives the product.
If the delivered product materially does not correspond to its documented description, the customer can submit a guarantee claim. After the claim is reviewed and accepted, the product may be returned through the authorized return procedure.
The guarantee supplements and does not exclude, restrict or replace mandatory statutory or consumer rights. Complete conditions are contained in the guarantee certificate and Terms & Conditions.
